The Connecticut ADU & Zoning Policy Atlas: Complete 169-Town Guide

The Connecticut ADU & Zoning Policy Atlas: Complete 169-Town GuideThis is a very detailed work in progress.  Need more help call or text 203-994-3950

Accessory Dwelling Units (ADUs)—also known as accessory apartments, in-law suites, carriage houses, or backyard cottages—represent the most significant shift in Connecticut residential land use in decades.

This atlas provides the authoritative legal foundation under Public Act 21-29, details local health and septic hurdles (B100a Application Reviews), and provides direct municipal land-use links and regulatory profiles for property owners, architects, and investors across all 169 Connecticut towns.

1. The Legal Blueprint: Connecticut Public Act 21-29

In 2021, the Connecticut General Assembly enacted Public Act 21-29 (codified under CGS § 8-2), establishing a statewide baseline designed to increase housing choice:

  • State Baseline Standard: Permitted at least one ADU as-of-right (administrative staff approval with no public hearing) on any single-family residential lot.

  • Structure Options: Allowed both attached (basement conversions, additions) and detached (backyard cottages, carriage houses) units.

  • Size Ceilings: Set maximum unit sizes at 1,000 sq ft or 30% of the primary dwelling’s floor area, whichever is less (towns may allow larger).

  • Parking Limits: Prohibited municipal commissions from requiring more than one dedicated off-street parking space per ADU.

  • Utility Protections: Prohibited utility authorities from charging disproportionate connection fees or treating an ADU as a separate commercial sewer/water entity.

The Statutory Opt-Out Mechanism

The legislation allowed municipal Planning and Zoning Commissions (P&Z) to opt out of the state default provisions by a two-thirds majority vote of both the P&Z commission and the local legislative body before January 1, 2023.

  • 115 Municipalities Opted Out: Retained local autonomy to enforce their own custom accessory apartment regulations.

  • 54 Municipalities Opted In (or missed the statutory deadline): Governed directly by statewide baseline standards under PA 21-29.

Opting out did not ban ADUs. Nearly all opt-out municipalities permit accessory apartments, but they enforce local conditions such as owner-occupancy covenants, detached setbacks, special permits, or square-footage limits.

2. Critical Regulatory Checkpoints

Every ADU project in Connecticut must clear four distinct statutory hurdles before construction:

  • As-of-Right vs. Special Permit: As-of-Right projects require only zoning staff and building official sign-off. Special Permits require public hearings before the P&Z Commission, certified mail notices to abutting neighbors, and formal architectural site reviews.

  • Subsurface Septic Review (B100a): In non-sewered towns, adding living space or bedroom counts triggers a mandatory CT DPH B100a Application Review. You must prove a code-compliant primary leaching system and a 100% reserve area on the lot.

  • Owner-Occupancy & Deed Restrictions: Many opt-out towns require the property owner to reside in either the primary home or the ADU, backed by a formal affidavit or deed covenant recorded on the town land records.

  • Short-Term Rental (STR) Restrictions: Under PA 21-29 § 6(d), municipalities retain the right to restrict or prohibit using accessory apartments as short-term rentals (stays under 30 days) via platforms like Airbnb or VRBO.
