1. The Legal Blueprint: Connecticut Public Act 21-29
In 2021, the Connecticut General Assembly enacted Public Act 21-29 (codified under CGS § 8-2), establishing a statewide baseline designed to increase housing choice:

The Statutory Opt-Out Mechanism
The legislation allowed municipal Planning and Zoning Commissions (P&Z) to opt out of the state default provisions by a two-thirds majority vote of both the P&Z commission and the local legislative body before January 1, 2023.

Opting out did not ban ADUs. Nearly all opt-out municipalities permit accessory apartments, but they enforce local conditions such as owner-occupancy covenants, detached setbacks, special permits, or square-footage limits.
2. Critical Regulatory Checkpoints
Every ADU project in Connecticut must clear four distinct statutory hurdles before construction:

As-of-Right vs. Special Permit: As-of-Right projects require only zoning staff and building official sign-off. Special Permits require public hearings before the P&Z Commission, certified mail notices to abutting neighbors, and formal architectural site reviews.

Subsurface Septic Review (B100a): In non-sewered towns, adding living space or bedroom counts triggers a mandatory CT DPH B100a Application Review. You must prove a code-compliant primary leaching system and a 100% reserve area on the lot.
